# Terms of Service

**Agreement**

By using the Addon Checkbox Order Bump app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please cease using the App. We (Appelevate) reserve the right to modify these Terms at any time, with changes taking effect when posted on our website or within the app. Continued use signifies your acceptance of those changes.

**Eligibility**

To use the App, you must have an active Shopify store and the authority to bind the store to these Terms.

**App Functionality**

The App enables you to:

* Create customizable order bumps with add-on product offers on product page.
* Set display rules and conditions to control their presentation.
* Track app usage data for analytics and improvement purposes.

**License**

Appelevate grants you a non-exclusive, non-transferable, revocable license to use the App solely within your Shopify store, subject to these Terms.

**Fees and Payment**

You agree to pay the fees associated with the App, as outlined on our pricing page or within the Shopify App Store. We may change our pricing with notice to you.

**Intellectual Property**

The App, including its code, design, and content, is Appelevate's property (or that of our licensors). You may not copy, modify, or reverse-engineer the App.

**User Content**

You are responsible for any content (product offers, images, etc.) you create using the App. You represent that you hold the necessary rights to use this content and it doesn't violate any intellectual property or other rights.

**Support**

We provide support for the App at <support@appelevate.tech>. Our support hours and response times may vary.

**Disclaimer of Warranties**

THE APP IS PROVIDED "AS IS," WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE RESULTS OR THAT THE APP WILL BE BUG-FREE.

**Limitation of Liability**

APPELEVATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM LIABILITY IS LIMITED TO THE FEES YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

**Indemnification**

You agree to indemnify and hold harmless Appelevate from any losses relating to your use of the App or any breach of these Terms.

**Termination**

You may discontinue using the App at any time. Appelevate may terminate your access to the App, without cause, upon notice. Upon termination, you must immediately cease using the App.

**Governing Law**

These Terms shall be governed by the laws of Indian jurisdiction, without regard to conflicts of law principles.
